FAQ / My fiance (fiancee) came to the United States on a K-1 Fiance (e) visa. Can he/she legally work here?

K-1 Fiance (e) visa holder is not automatically authorized to work in the USA. But after arriving in the United States, your fiance (fiancee) will be eligible to apply for a work permit using Form I-765, Application for Employment Authorization.
You should know that USCIS might not be able to process the work permit within the 90-day time limit for your marriage to take place.
If your fiance (fiancee) applies for adjustment to permanent resident status after your marriage, he/she must re-apply for a new work permit.
