News / House bill would allows swearing in overseas

RICHMOND - Haymarket Councilman John Cole is running for re-election - from Iraq.

If he wins, he'll also be sworn in there.

A new provision in Virginia law will be needed to let the 47-year-old Department of Defense worker take his oath of office from Baghdad, and on Wednesday the House of Delegates passed an emergency measure to allow it.

The bill heads to the Senate today.

Cole is working with the Iraqi military for six months and if he wins re-election on May 6, he wouldn't return in time for the July 1 swearing in with the rest of Haymarket's Town Council.

"He wants to serve his town and he wants to serve his country and he didn't want to have to choose between the two," said Town Manager Gene Swearingen.

So Del. Robert G. Marshall, R-Prince William, submitted a bill to the General Assembly that lets active duty military personnel and civilian workers to be sworn in by a notary in another country.

"Great things are happening in town and we need to press on," Cole said during a phone interview this week. He left for Baghdad on Wednesday.

He said his wife, Ellie, and other council members are going to distribute campaign literature for him while he's gone. Interested voters can e-mail him if they have questions, he said.

First appointed three years ago, Cole is running for his second two-year term.

He was the town's vice mayor until Monday, when he resigned and was replaced by acting Vice Mayor Councilman Oswald Vazquez.

Cole said he'd return to the U.S. in early August. By that time he'd have only missed one meeting, provided that he receives enough votes to keep his seat.

Haymarket's election is on May 6. All at-large council seats are up for re-election.
