NEWS / Effective immediately! New laws put on the books


VietNamNet Bridge - Many new laws of interest to both people and businesses took effect on July 1, 2007.



Among the laws: Residence Law, Notaries Public Law, Law on Gender Equality, Law on Organ and Tissue Donation, Law on Overseas Labourers, Law on Technology Transfer, Amended Labour Code, Law on Tax Management, Law on Vocational Training, Law on Sports and Physical Training and Law on Dykes.


Individuals allowed to open notary public chambers



The right of free residence under the Residence Law permits Vietnamese citizens to freely select where they reside.



Under the Law on Notaries Public, notaries who meet conditions stipulated in the law can open notary public chambers in the form of a private firm, creating a healthy competition environment among notary public chambers.



As of July 1, notary public chambers no longer certify copies; this task is transferred to People’s Committees at all levels.


Wives and husbands are equal in owning assets in family



The Law on Gender Equality sets gender equality rules in all fields of social life and family, measures to ensure gender equality, and the responsibility of organisations, families and individuals in maintaining gender equality.



The law stipulates that wives and husbands are equal in civil relationships and other relations related to marriage and family. They also have equal rights and duties in owning assets in the family and equally use the common sources of income.


Taxpayers have the right to ask for secrecy



The Law on Tax Management defines some rights of tax payers, both organisations and individuals, such as asking tax agencies to explain tax policies and keep their information secret.

Prohibiting trade of human tissues and organs



Under the Law on Organ and Tissue Donation, citizens of 18 years old and up who meet certain requirements have the right to donate tissues and organs while they are alive or after death and donate their bodies.



The law bans acts such as tissue and organ thievery and trading, advertising brokerage services for human tissue and organ donations for commercial purposes, disclosing information about the donators and the receivers.



The Law on Overseas Labourers gives two new forms of organisations that are allowed to send labourers to work abroad. Diplomatic agencies of Vietnam abroad must protect the legal rights and interests of Vietnamese labourers abroad.
