NEWS / Moroccan Notary Public Sentenced to Prison for Embezzling Millions


A Moroccan notary public has been sentenced to one year in prison and ordered to pay significant fines and compensation after being found guilty of misappropriating over 10 million Moroccan dirham (approximately $980,000) from clients. This case highlights the ongoing issue of embezzlement within the legal profession in Morocco.

According to Morocco World News, The sentence was handed down on Monday by the Criminal Court of First Instance in Rabat, following investigations into the notary's activities. According to court documents, the accused embezzled funds intended for housing loans granted by a bank to clients. The bank filed a complaint with the public prosecutor after discovering manipulations and discrepancies in the notary's handling of the funds.

The legal representative of the bank argued that the embezzled funds were considered public funds due to their connection to state finances. This categorization elevated the charges against the notary to "embezzlement and misappropriation of public and private funds," resulting in a harsher sentence.

This conviction is particularly concerning given the accused's previous record. He had previously received multiple sentences for various offenses, including fraud, breach of trust, and mismanagement of funds. This history of misconduct raises questions about the vetting process and oversight mechanisms within the notary public profession in Morocco.

Unfortunately, this case is not an isolated incident. In March 2022, another notary public in Marrakesh fled with MAD 30 million (approximately $3 million) stolen from over 45 clients. This individual used his knowledge of legal procedures to deceive his victims, highlighting the vulnerabilities inherent in relying on a trusted professional.

These repeated instances of embezzlement by notaries public have eroded public trust in the profession and raised concerns about the need for stricter regulations and oversight. The authorities must take decisive action to address this issue by implementing robust vetting procedures, increasing transparency in financial transactions, and holding offenders accountable to the fullest extent of the law.
