NEWS / Birth Certificate to Determine Bathroom Access: Utahans Divided Over New Gender Bill


Utahans are grappling with mixed emotions following the passage of HB257, a controversial bill that dictates public restroom and locker room usage based on individuals' birth certificates. Titled "Sex-based Designations for Privacy, Anti-Bullying, and Women's Opportunities," the bill has ignited a debate surrounding personal privacy, gender identity, and inclusivity.

Proponents of the bill, which passed the State House 52-17, argue it protects "bad actors" from exploiting open bathroom access, as stated by its sponsor, State Representative Kera Birkeland.

"We've got nothing against anybody," she clarified, as quoted by KUTV, "but that is just how I feel, a girl should go to a girls, a guy should go to a guys, whether they want to be transgender or not."

Critics, however, express concerns about the bill's impact on transgender individuals and those questioning their gender identity.

"Just excluding them from being comfortable in their own bodies, gives a rise to suicide rates," argued Tysen Christensen, echoing worries about potential mental health consequences. Allie Nash added, "Most people that are wanting to use the bathroom that might not identify with their gender are just trying to use the bathroom, there is not really a need to make a big deal out of it."

The bill hinges on birth certificates as the sole identifier for restroom access. While it allows individuals who have legally transitioned and updated their birth certificates to use facilities associated with their new gender, the restriction for others remains a cause for concern.

"I feel like it's very inappropriate to do that because there is a lot of teenagers and adults with mental health issues surrounding their gender and what they identify as," Christensen noted.
